Welcome, safety guidelines and member terms, version 1.0
Welcome, and thank you for being here. We understand that life with a new baby often means juggling many things while feeling tired, and our primary goal is to provide a safe space for you to rest and feel centred. Before you begin, let your shoulders soften and your breath open, then take two minutes to read the guidelines below. They exist because your wellbeing and the safety of your baby are always our highest priority, which is why we ask every member to accept them before listening.
By tapping "I Accept" you confirm that you are 18 or over, that you have read and understood these terms, and that you agree to be bound by them. If you do not agree, please do not use the app.
1. The nature of our content
mother.fm provides audio coaching, affirmations, meditations and general wellbeing information for the purposes of relaxation and personal development. mother.fm is not a medical service or a form of therapy, and nothing within the app constitutes medical, psychological, nutritional or other professional advice, diagnosis, treatment or care. Any information relating to postnatal recovery, hormones, supplements or mental health is general and educational in nature, may not be appropriate for your individual circumstances, and must never be relied upon in place of advice from a qualified professional who knows you and your history. Experiences of the content vary from person to person, and we make no guarantee of any particular result or benefit.
Our postnatal timelines have been reviewed by a registered medical doctor for general accuracy at the time of review. That review relates to the information as it applies to the general population. The reviewing doctor has not assessed you, has no knowledge of your medical history, and is not providing you with individual advice, diagnosis, treatment or care. Every postnatal recovery is different, and your own doctor, midwife or health visitor remains the right person to advise you on your circumstances.
You should not delay seeking professional advice, or disregard advice you have been given, because of anything you have heard or read in the app. Please consult your doctor, midwife or pharmacist before acting on any information about supplements, medication or physical recovery, particularly if you are breastfeeding or have an existing health condition.
2. Your mental health
If you feel that your mental health is suffering at any point, please seek medical advice from your doctor, midwife or health visitor as soon as you can. If you have an existing mental health condition, or have experienced a traumatic birth, we recommend speaking to a healthcare professional before beginning any meditation or affirmation practice. Should any audio bring up distress or make you feel worse, stop listening and seek support. mother.fm is not a crisis service and the app is not monitored. If you have thoughts of harming yourself or your baby, or you feel unable to keep yourself safe, call 999 or go to your nearest accident and emergency department. For urgent but non emergency help you can call NHS 111, and Samaritans are available at any hour on 116 123. If you are outside the United Kingdom, please contact your local emergency services.
3. Critical safety warnings
Our content is designed to promote relaxation and may cause drowsiness. You must not use the app, including listening to any meditation or affirmation, while you are:
- Driving or operating any vehicle or machinery.
- Engaged in any activity that requires your full attention, including bathing your baby, cooking, or moving on stairs or near water.
- Holding, carrying, feeding or wearing your baby or child in circumstances where drowsiness or falling asleep is possible.
Sleep meditations.
Our sleep meditations are created to help you fall asleep and must only be played once your baby is settled in their own safe sleep space, such as a cot or Moses basket, or is in the care of another responsible adult. You must never play a sleep meditation while holding, feeding or wearing your baby, while your baby is lying on your chest, or while your baby is sharing your bed, sofa or armchair with you. These audios are for your rest alone, after your baby has been put down safely.
If you begin to feel drowsy while listening to any audio, stop immediately and place your baby on a safe, flat sleep surface such as a cot or Moses basket. Never allow yourself to fall asleep with your baby on a sofa or armchair. When using headphones, keep the volume low enough that you can always hear your baby. Some audios include breathing or gentle movement practices, and you should check with your doctor, midwife or a women's health physiotherapist before attempting these after birth, particularly following a caesarean or complicated delivery, and stop at once if you feel pain or dizziness. Choosing a safe time and place to listen is your responsibility alone.
4. Assumption of risk
You acknowledge that you use mother.fm voluntarily and entirely at your own risk, that you remain solely responsible for your own safety and for the safety and supervision of any child in your care, and that you are responsible for any decision you make on the basis of content in the app.
5. Limits of our liability
To the fullest extent permitted by law, MOTHER.FM LIMITED and its directors, employees, contributors and partners accept no liability for any loss, damage, injury or expense suffered by you or by any third party, including your baby or child, arising from:
- Your failure to follow the safety warnings in Section 3, including any accident or injury that occurs while listening when drowsy, while holding your baby, or while using a sleep meditation in breach of that section.
- Your reliance on any information, content or guidance provided through the app.
- Any decision to delay or forgo medical, psychological or other professional advice.
- Any product, service or website of a third party that is mentioned, linked or offered in connection with mother.fm, none of which we control or endorse.
- Any interruption, error or unavailability of the app.
If we are ever found responsible for a loss, our total liability is limited to the amount you have paid to mother.fm in the previous twelve months, and we are not responsible for losses that could not reasonably have been foreseen. These terms do not remove any liability or consumer right that the law says cannot be removed.
6. Our content is for you alone
All audio, text, imagery and design within mother.fm is owned by or licensed to MOTHER.FM LIMITED and is protected by copyright and trade mark law. Your membership gives you a personal, non transferable licence to access the content for your own private use. You must not screenshot, screen record, download, copy, reproduce, transcribe, share, post or distribute any part of the content, whether on social media, in messaging groups or by any other means, and you must not use it for any commercial purpose or to train any software or artificial intelligence system. You will be responsible for any loss we suffer as a result of a breach of this section.
7. One account, one device
Your login is personal to you and is locked to a single registered device. Sharing your login credentials with anyone else is not permitted, and you are responsible for keeping them secure. If you replace your device, contact us and we will transfer your access. We may suspend or terminate access, without refund, where we reasonably believe that login details have been shared or that Section 6 has been breached.
8. Your membership, payments and cancellation
Monthly membership. Your monthly membership renews automatically on the same date each month, at the price shown when you joined. You can cancel at any time before your next payment date by emailing us at the address in Section 10, and no further payments will be taken. You will keep access until the end of the month you have already paid for, and we do not refund part months.
Lifetime membership. A lifetime membership is a single payment with no renewals, so there is nothing to cancel. It lasts for as long as mother.fm continues to operate the app, which means it does not refer to your own lifetime. We may add, update or remove content and features from time to time. If we ever decide to close the app, we will give members at least 30 days' notice.
Currency. All prices are shown in pounds sterling (GBP) and all payments are taken in pounds sterling. If you are joining from outside the United Kingdom, your bank or card provider will convert the amount into your own currency at its exchange rate on the day and may add a foreign transaction fee. The amount on your statement may therefore differ from the price shown and, for monthly members, may vary slightly from month to month. Please check with your bank or card provider if you would like to know the exact amount before you join. mother.fm has no control over exchange rates or bank charges and is unable to refund them.
Your right to change your mind. Your membership gives you immediate access to digital content. By accepting these terms you ask us to begin supplying that content straight away, and you acknowledge that your 14 day right to cancel under the Consumer Contracts Regulations ends once access begins. Except where the law requires otherwise, payments are non refundable. This does not affect your legal rights if the content is faulty or not as described.
9. Your privacy
MOTHER.FM LIMITED is the controller of your personal information, is registered with the Information Commissioner's Office under registration reference ZC121603, and handles your information in line with United Kingdom data protection law. This section is our privacy notice, and you can ask us for a copy of it at any time by emailing the address in Section 10.
What we collect. We collect the following:
- The details you give us when you create an account, such as your name and email address.
- Information about your membership and payments, which are processed securely by our payment provider so that we never see or store your full card details.
- Information about how you use the app, such as which audios you have played.
- Anything you choose to enter into the app's planning tools.
To operate the single device login described in Section 7, we also record an identifier for your registered device.
Why we collect it. We use this information to provide your membership, to keep your account secure, to improve our content, and to meet our legal obligations. Our legal grounds for doing so are that the information is necessary to perform our contract with you and to meet legal requirements, and that we have a legitimate interest in running and improving the service securely. We will only send you marketing emails where you have agreed to receive them, and you can unsubscribe at any time.
Who we share it with. We do not sell your personal information. We share it only with the service providers who host the app, process payments or send emails on our behalf, under contracts that require them to protect it. Some of these providers may be located outside the United Kingdom, in which case we make sure that appropriate legal safeguards are in place.
Information about other people. Where you enter information about another person, such as a partner's name or details about your baby, you confirm that you are entitled to share it, and we use it only to provide and tailor your experience of the app.
Health information. mother.fm does not ask for your medical history and does not need it in order to work. Please do not enter medical details about yourself or anyone else into free text areas of the app.
How long we keep it. We keep your information for as long as your account is active and for up to 12 months afterwards, unless the law requires us to keep it for longer.
Your rights. You have the right to ask for a copy of your information, to have it corrected or deleted, to object to or restrict how we use it, and to receive it in a portable format. To exercise any of these rights, contact us at gds@mother-fm.com. You also have the right to complain to the Information Commissioner's Office at ico.org.uk.
10. General
We may update these terms from time to time and will ask you to accept the revised version when you next log in. If any part of these terms is found to be unenforceable, the remainder will continue to apply. These terms are governed by the laws of England and Wales, and if you live in Scotland, Northern Ireland or outside the United Kingdom you keep any mandatory protections of the law where you live. mother.fm is operated by MOTHER.FM LIMITED, company number 16670425, registered office 1 Sindercombe Mews, London W12 9BQ.
